EU: Update on transition period for cybersecurity for radio equipment

New application date: August 1st 2025

From August 2024, additional requirements should actually apply to radio equipment, namely those that are connected to the Internet.

  • The protection of privacy.
  • The protection of personal data.
  • The protection of the communications network. And.
  • The protection of monetary values.

All of this is applied by Delegated Regulation (EU) 2022/30, supplementing the Radio Equipment Directive 2014/53/EU. Specifically, the sub-paragraphs of Article 3(3) d, e and f have been backed up with requirements here.

We are now waiting for the publication in the Official Journal. Then the new date for application of Delegated Regulation (EU) 2022/30 is August 1st 2025.

After the EU Commission has gathered feedback from the business community, among others, and has now adopted the amendment, the Parliament and Council have two months to raise objections. Otherwise, the delegated act will enter into force.

Basically, the feedbacks argue similarly. There was a request for deferral because there are currently no usable draft standards from the JTC 13/WG8 working group. Mandate M/585 for the development of harmonized standards to CEN and CENELEC was not issued until August 2022.

Furthermore, if there are no harmonized standards with citation in the Official Journal at the end of the transition period, a notified body must be involved in the conformity assessment, which entails the need for an EU type examination certificate.

There are doubts about the necessary resources of the notified bodies. Currently, not even enough notified bodies are equipped with the necessary competences.
