EU: RoHS exemptions update

EU Commission publishes August 2024 version

The EU Commission has updated its "RoHS 2 exemptions - Validity and rolling plan". This documents the current status of the RoHS exemptions. After various exemptions expired in July 2024 and some new extension applications were submitted, a new version is now public on August 6, 2024.

The following differences to the last version (September 2023) are recognizable

  • No longer valid
    • 50 further expired and non-renewable exemptions; mainly affect categories 9 industrial, 8 in vitro and 11 with the expiration date July 21, 2024

  • Valid - no longer renewable
    • Annex III - Exemption 39(a) for all categories until November 21, 2025
    • Annex IV - exemption 37 for all categories until December 31, 2025

  • Valid - requested for renewal
    • Annex III - Exemption 24 for category 11
    • Annex IV - Exemption 49 for category 9

  • New exemptions (Valid)
    • Annex III - Exemption 39(b) for all categories until December 31, 2027
    • Annex III - Exemption 46 for category 11 until May 28, 2028

There is no update regarding the validity of 114 exemptions for which an extension was requested in good time ("Valid - requested for renewal" status). These include Annex III exemption 6(a)-(c). New in the August 2024 version is the column "Last date of submission", which shows the last receipt of renewal applications.

We are always happy to answer any questions you may have about the exceptions
