EU: New substances in the focus of the REACH regulation

Lead in PVC, formaldehyde and others

New on the candidate list

On June 14th 2023, the candidate list was extended by two entries and thus the following substances. The inclusion of a substance in the candidate list immediately triggers the information obligation according to REACH Article 33. Manufacturers and importers of an article containing a candidate list substance must inform their downstream users that a substance is present in the homogeneous material in a concentration above 0.1%.

Diphenyl(2,4,6-trimethylbenzoyl)phosphine oxide

  • CAS No.: 75980-60-8
  • EC No: 278-355-8
  • Examples of use: Inks and toners, coating products, photographic chemicals, polymers, adhesives, sealants and fillers, putties, plasters, modeling compounds.

Bis(4-chlorophenyl) sulphone

  • CAS No.: 80-07-9
  • EC No.: 201-247-9
  • Applications: Production of chemicals, plastic and rubber products.

Note: Bis(4-chlorophenyl) sulphone (CAS: 80-07-9) is also regulated under Regulation (EU) No. 10/2011 on plastic materials and articles intended to come into contact with food (food contact) (see Table 1 of the Regulation).

 

New restrictions in Annex XVII

Lead in PVC

Regulation (EU) 2023/923 amends REACH Annex XVII regarding lead and its compounds in PVC. Accordingly, lead may no longer be present in PVC material at a concentration of 0.1% or more by weight. This regulation will apply from November 29th 2024. For details of deviating regulations, please refer to paragraphs 17 - 20 of REACh Regulation Annex XVII, entry 63. 


Formaldehyde

Regulation (EU) 2023/1464 amends REACH Annex XVII with regard to formaldehyde and formaldehyde releasers. It takes effect on August 6th 2023 and adds entry 77. Formaldehyde (CAS No. 50-00-0; EC No.: 200-001-8) and formaldehyde releasers shall (1.) no longer be present in wood-based articles after August 6th 2026, and (2.) no longer be present in road vehicles after August 6th 2027. Note the conditions and exemptions of entry 77 and the specified test methods in Annex 14 of Regulation (EU) 2023/1464.
